Friendbee: Website terms and conditions of use
- Introduction
1.1 These terms and conditions apply to your use of our FriendBee website, which is a service provided by Ruils. Ruils is a local charity that supports children and adults with disabilities and the elderly to live independently, be part of their community and to live life to the full. We provide information, advice, befriending and activities to our clients and their families. We are a registered charity (no: 1127896) and a charitable company limited by guarantee (England and Wales no. 6682677). The FriendBee website helps to facilitate a SEND Befriending Service that matches children and young people with a paid Befriender to help them access social and leisure activities. Please read these terms and conditions. Together with the other documents we have provided to you (for example, the Employee Handbook, the Casual Worker Contract and the Code of Behaviour and Conduct, (for Befrienders); and the Family Handbook and Family Agreement (for Families) these terms and conditions form part of the agreement between us in relation to your participation with FriendBee.
1.2 By using our website, you accept these terms and conditions. If you have any questions about these terms and conditions, please speak to us. You can find out how to contact us in section 20, at the end of these terms and conditions.
1.3 You must be at least 18 years of age to use our website. If you are not yet 18, please speak to you parent or guardian and ask them to use this website on your behalf. If you are under 17, you may use the website to apply to become a Befriender, provided that you may only start work as a Befriender once you turn 18.
- Permission to use website
2.1 You may use this website to find out more about FriendBee. You may use this website to register to use the service as a family or apply to become a Befriender. If you are a family who's already registered with us, or a Befriender, you may use this website to publish your profile, contact Befrienders or families (respectively); contact the coordinators; submit timesheets; and generally manage your participation in FriendBee. Please do not download any text or photos from our website or save any such material to your computer.
2.2 We may sometimes need to suspend access to the website, for example, during server maintenance or when we update the website. We'll try to let you know in advance if the website is going to be offline for more than one day.
- Misuse of website
3.1 We want everyone to enjoy using our website. Please follow these Acceptable Use rules, and the Content Rules in section 10.3 below to make sure we are a friendly, welcoming, safe website for all our users. Please do not: use our website in any way that causes damage to the website;
(a) use our website in any way that is unlawful, illegal, fraudulent or harmful;
(b) hack our website;
(c) use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
(d) conduct any systematic or automated data collection activities on or in relation to our website;
(e) access or otherwise interact with our website using any robot, spider or other automated means, except for the purpose of search engine indexing;
(f) use data collected from our website for any direct marketing activity;
(g) use our website in violation of our Code of Behaviour and Conduct or Family Agreement; or
(h) do anything that interferes with the normal use of our website.
3.2 Please make sure the messages you send and your profile is true, accurate, current, complete and non-misleading.
- Registration and accounts
4.1 You may register for FriendBee by completing and submitting the employment application form (Befrienders) or family registration form (families). We will review your application/registration and we will contact you to discuss your eligibility and next steps.
4.2 Please do not let any other person to use your account to access the website.
4.3 Please tell us straight away if you become aware of any unauthorised use of your account.
4.4 You must not use any other person's account to access the website.
- User login details
5.1 Please keep your password and log in details confidential.
5.2 Please tell us immediately if you become aware of any disclosure of your password.
- Cancellation and suspension of account
6.1 We may:
(a) temporarily suspend your account; and/or
(b) cancel your account,
at any time at our sole discretion, if we have reasonable grounds to believe that: your account is inactive; or it is necessary to protect us, Befrienders or Families.
6.2 If you decide to end your relationship with us, the instructions about how to do this are in your Family Agreement or your Employment Agreement. When our relationship ends, you will no longer be able to log into and access your account.
- Personal profiles
7.1 Please keep your personal profile up to date.
7.2 Personal profile information must also comply with the provisions of Section 3 and Section 10.
- Fees
8.1 You do not need to use the website to make any payments or receive money. Families can view and download their invoices from the website, which are payable via bank transfer (details on the invoice). Befrienders are paid to their bank account.
- Our rights to use your content
9.1 In these terms and conditions, "your content" means your profile and any messages you send through the website.
9.2 You grant to us permission to publish your profile, to send your messages and to perform administration services via the website, as requested by you.
9.3 Please be aware that if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, un-publish or edit any or all of your content.
- Rules about your content
10.1 You promise that your content will comply with these terms and conditions.
10.2 Your content must not be illegal or unlawful, must not infringe any person's legal rights.
10.3 We want everyone to enjoy using the FriendBee website and being part of our community. Please make sure your content is not:
(a) obscene or indecent;
(b) discriminatory on the grounds of race, religion, belief, disability, gender, gender reassignment, age, a persons’ marital status or sexual orientation;
(c) depicting violence in an explicit, graphic or gratuitous manner;
(d) pornographic, lewd, suggestive or sexually explicit;
(e) untrue, false, inaccurate or misleading;
(f) consisting of or containing any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;
(g) spam;
(h) offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory;
(i) in breach the Code of Behaviour or Conduct/Family Agreement; or
(j) causing annoyance, inconvenience or needless anxiety to any person.
10.4 Your content must be appropriate, civil and tasteful, and accord with generally accepted standards of etiquette and behaviour on the internet.
- Report abuse
11.1 If you learn of any unlawful material or activity on our website, or any material or activity that breaches these terms and conditions, please let us know straight away.
11.2 You can let us know about any such material or activity by flagging the content as inappropriate or contacting us using the methods described in section 20 below.
- Limited warranties
12.1 We do not warrant or represent:
(a) the completeness or accuracy of the information published on our website;
(b) that the material on the website is up to date;
(c) that the website will operate without fault; or
(d) that the website or any service on the website will remain available.
12.2 To the maximum extent permitted by applicable law and subject to Section 13.1, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our website and the use of our website.
- Limitations and exclusions of liability
13.1 Nothing in these terms and conditions will:
(a) limit or exclude any liability for death or personal injury resulting from negligence;
(b) limit or exclude any liability for fraud or fraudulent misrepresentation;
(c) limit any liabilities in any way that is not permitted under applicable law; or
(d) exclude any liabilities that may not be excluded under applicable law,
and, if you are a consumer, your statutory rights will not be excluded or limited by these terms and conditions, except to the extent permitted by law.
13.2 The limitations and exclusions of liability set out in this Section 13 and elsewhere in these terms and conditions:
(a) are subject to Section 13.1; and
(b) govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
13.3 As our website is provided to you free of charge, we will not be liable for any loss or damage of any nature caused by our website.
13.4 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
13.5 We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
13.6 We will not be liable to you in respect of any special, indirect or consequential loss or damage, providing that if you contract with us under these terms and conditions as a consumer, this Section 13.6 shall not apply.
13.7 You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).
- Breaches of these terms and conditions
14.1 Please note that in order to protect our FriendBee community, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
(a) temporarily suspend your access to our website;
(b) permanently prohibit you from accessing our website; or
(c) suspend or delete your account on our website.
- Third party websites
15.1 Our website may include hyperlinks to other websites owned and operated by third parties; such hyperlinks are not recommendations and we have no control over or responsibility for such third party websites.
- Variation
16.1 We may revise these terms and conditions from time to time.
16.2 The revised terms and conditions shall apply to the use of our website from the date of publication of the revised terms and conditions on the website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions.
- Severability
17.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
17.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
- Third party rights
18.1 A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.
18.2 The exercise of the parties' rights under a contract under these terms and conditions is not subject to the consent of any third party.
- Law and jurisdiction
19.1 These terms and conditions shall be governed by and construed in accordance with English law.
19.2 Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
